1. Right to object

Please note the following with respect to your right to object:

When we process your personal data for the purpose of direct marketing, you have the right to object to this data processing at any time without providing the reasons for such objection. This also applies to profiling insofar as it is associated with direct marketing.

If you object to the processing for direct marketing, we will no longer process your personal data for such purposes. The objection is free of charge and can be made informally, where appropriate to: marketing.wmc@wika.com.

Should we process your data to protect legitimate interests, you may object to such processing at any time for reasons that arise from your specific situation; this also applies to profiling based on these provisions.

We will then cease to process your personal information unless we can demonstrate compelling legitimate grounds for processing such information that outweigh your interests, rights and freedoms, or the processing is intended to assert, exercise or defend legal claims.

 

2. Purposes and legal bases of data processing

The processing of your personal data complies with the provisions of the GDPR and all other applicable data protection regulations. Legal bases for data processing arise in particular from Art. 6 GDPR.

We use your data to initiate business, to fulfil contractual and legal obligations, to conduct the contractual relationship, to offer products and services and to consolidate customer relationships, which may include marketing and direct marketing.

Your consent is also a permission regulation for data protection. Here we inform you about the purposes of data processing and your right of revocation. If the consent also refers to the processing of special categories of personal data, we will expressly point this out to you in the consent.

Processing of special categories of personal data in the sense of Art. 9 Paragraph 1 EU-GDPR only takes place if this is required by legal regulations and there is no reason to assume that your legitimate interest in the exclusion of processing predominates.

 

3. Data transfers / Disclosure to third parties

We will only transmit your data to third parties within the scope of given statutory provisions or based on consent. In all other cases, information will not be transferred to third parties unless we are obliged to do so owing to mandatory legal regulations (disclosure to external bodies, including the supervisory authorities or law enforcement authorities).

 

4. Data recipients / categories of recipients

In our organisation, we ensure that only individuals who are required to process the relevant data to fulfil their contractual and legal obligations are authorised to handle personal data. In certain cases, however, your data is also collected, processed and used by other companies of the WIKA Group (group companies) or by service providers in a business relationship with us.

In many cases, service providers assist our specialist departments to fulfil their tasks. The necessary data protection contract has been concluded with all service providers. The transfer of data by service providers to third parties is expressly prohibited.

 

5. Transfers of personal data to third countries 

Data are generally not transferred to third countries (outside the European Union or the European Economic Area). Any external data storage devices we may use are hosted within the European Union. Should a data transfer to third countries take place in individual cases, this will be indicated separately in each case. All data protection requirements are fulfilled, in particular in these individual cases an EU standard contract is concluded with the business partner.

 

6. Period of data storage

We store your data for as long as such is required for the relevant processing purposes. Please note that numerous retention statutory periods require that data must be stored for a specific period of time. This relates in particular to retention obligations for commercial or fiscal purposes (e.g. commercial code, tax code, etc.). The data will be routinely deleted after use unless a further period of retention is required.

We may also retain data if you have given us your permission to do so, or in the event of any legal disputes and we use the evidence within the statutory limitation period, which may be up to 30 years; the standard limitation period is 3 years.

 

7. Secure transfer of data

We implement the appropriate technical and organisational security measures to ensure the optimal protection of the data stored by us against accidental or intentional manipulation, loss, destruction or access by unauthorised persons. The security levels are continuously reviewed in collaboration with security experts and adapted to new security standards.

The data exchange to and from our website is encrypted. We provide https as a transfer protocol for our website, and always use the current encryption protocols. In addition, we offer our users content encryption in our contact forms and applications. We alone can decrypt this data. It is also possible to use alternative communication channels (e.g. surface mail).

 

8. Obligation to provide data

A range of personal data is required to establish, implement and terminate the obligation and the fulfilment of the relevant contractual and legal obligations. The same applies to the use of our website and the various functions we provide.

We have summarised the relevant details in the above point. In some cases, legal regulations require data to be collected or made available. Please note that it will not be possible to process your request or execute the underlying contractual obligation without this information.

 

9. Data categories, sources and origin of data

a. When you visit our website, we collect and process the following data:

  • Name of the Internet service provider
  • Information on the website from which you visited us
  • Web browser and operating system used
  • The IP address by your allocated Internet service provider
  • Files accessed, volume of data transferred, downloads/file export
  • Information on websites accessed on our site, including date and time
  • For reasons of technical security (in particular to safeguard against attempts to attack of our web server), this data is stored in accordance with Article 6 (1) lit f GDPR. Anonymisation takes place no later than after seven days by abbreviating the IP address so that no reference is made to the user.

 

b. In the context of a contact inquiry with the integrated contact form, we collect and process the following data (depending on the selection of the user):

  • Your request (mandatory field; all forms)
  • Your region (mandatory field; all forms)
  • Searched market (mandatory field; dealer search)
  • First name (mandatory field; contact form, service form, press request)
  • Last name (mandatory field; contact form, service form, press request)
  • Company (voluntary information; contact form, service form, press request)
  • Email-address (mandatory field; contact form, service form, press request)
  • Phone (voluntary information; contact form, service form, press request)
  • Service-type (voluntary information; selection list; service form)
  • Subject (voluntary information; service form)
  • Your message (voluntary information; contact form, service form, press request)
  • Optional: Subscribe to the CONTROL unlimited newsletter by activating a checkbox. Sending the request does not require registration for the CONTROL unlimited newsletter.

 

c. For online applications we collect and process the following data:

  • Last name, first name
  • Address
  • Contact data
  • Curriculum vitae, photo, employer's references, any other attachments that you provide to us. The data will be kept by us for a period of 6 months. If you give us your consent, the data will be stored accordingly for a longer period and can be exchanged between the individual companies of the WIKA Group.

All online applications are processed via the applicant portal of WIKA Alexander Wiegand SE & Co. KG. 10. Contact form / Contact via email (Article 6 (1) lit a, b GDPR)

An integrated contact form is available on our website which can be used to contact us electronically. If you write to us using the contact form, we will process the data you submitted in the contact form to respond to your queries and requests.

In so doing, we respect the principle of data minimisation and data avoidance, such that you only have to provide the information we require to contact you, which is your email address and the message field itself. At the beginning, the user is asked to indicate his region and the concern. For this reason, the user can be shown exactly the right contact. Also we collect your name for the purpose of personal contact. If the contact is made within the scope of a service request, only your e-mail address is required. In both cases, your IP address will be processed for technical reasons and for legal protection. All other data is voluntary, and additional fields are optional (e.g. to provide a more detailed response to your questions).

If you contact us by email, we will process the personal information provided in the email solely for the purpose of processing your request. If you do not contact us using the forms provided, no additional data will be collected.

 

11. Newsletter (Article 6 (1) lit a GDPR)

You can subscribe to the free newsletter CONTROL unlimited on our website. The email address, title and name you provided when you subscribed to the newsletter will be used to send the personalised newsletter.

The principle of data minimisation and data avoidance is observed here, as only the email address and your name is marked as mandatory. Your IP address will also be processed when you subscribe to the newsletter for technical reasons and legal protection.

You can of course terminate the subscription at any time via the opt-out option provided in the newsletter and therefore withdraw your consent.

 

12. Registration / Customer account for “WMC+” (Article 6 (1) lit a, b GDPR)

Certain user groups can provide personal data to enable them to register with WMC+ on our website.

WMC+ is a password-protected online area in which certain user groups gain access to information, documents and records. Registration is required to gain access to this area. If the registration is accepted by WIKA Mobile Control GmbH & Co. KG, the user will automatically be added to the e-mail distribution list for the so-called "WMC+ Update Mails". With these e-mails the user is notified about new, changed or removed documents in the download area. The user can unsubscribe from this mail service with an informal e-mail to marketing.wmc@wika.com.

The principle of data minimisation and data avoidance is observed here, as only the mandatory data fields required for registration are marked with an asterisk (*). These are the gender, the e-mail address and the password including password re-entry. In addition, the consent to the collection of electronic data must be confirmed in the form of a checkbox.

When you register on our website, the user’s IP address and the date and time of registration are also stored (technical background data). By ticking the above mentioned checkbox for the data protection declaration and by clicking the "Confirm" button, you give your consent to the processing of your data.

Please note: We will encrypt the password you entered which will be stored with us. Our company employees cannot view this password and cannot therefore assist you if you forget it.

In this event, use the "Forgotten password" function, which will send you an automatically generated link by e-mail. Click on this link and assign yourself a new password. No employee is authorised to request your password by telephone or in writing. Please never disclose your password should you receive such requests.

Upon completion of the registration process, your data will be stored with us for use in the protected customer area. When you log in to our website with your email address as your username and your password, this data will be made available to you on our website.

Registered persons are free to make their own changes to their user profile. You can of course cancel or delete the registration or your customer account. When you delete your customer account, all your related data is automatically deleted.

 

13. Marketing purposes (Article 6 (1) lit f GDPR)

WIKA Mobile Control GmbH & Co. KG is keen to nurture the customer relationship with you and to send you information and offers about our product / services. These include important information about new products, product changes or practical system applications. Therefore, we process your data in order to send you relevant information and offers by e-mail.

You may object to the use of your personal data for the purpose of direct marketing at any time; this also applies to profiling insofar as it is associated with direct marketing. If you object, we will cease processing your personal information for this purpose.

a. Google Analytics

This website uses Google Analytics, a web analysis service of the Google Inc. („Google“). The information generated by the cookie concerning your use of this website will be passed on to a Google server in the USA and saved there. On our website we use Google Maps (API) from Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). Google Maps is a web service that displays interactive (land) maps to visually represent geographic information. Using this service will show you our location and make it easier for you to get there.

Already when you call up the subpages in which the Google Maps map is integrated, information about your use of our website (such as your IP address) is transferred to Google's servers in the USA and stored there. This takes place regardless of whether Google provides a user account that you are logged in to or whether there is no user account. If you're logged in to Google, your information will be directly associated with your account. If you do not want your profile to be associated with Google, you must log out before activating the button. Google LLC, headquartered in the United States, is certified under the EU-U.S. “Privacy Shield” Agreement, which ensures compliance with EU privacy standards.

If you do not agree with the future transmission of your data to Google within the scope of the use of Google Maps, there is also the possibility of completely deactivating the Google Maps web service by switching off the JavaScript application in your browser. On our website, we are using an analysis service called "Demandbase" (Demandbase, Inc., 680 Folsom Street, Suite 400, San Francisco, CA 94107, USA). Demandbase uses "cookies" or "TAGs" that are stored on your computer and allow us to analyze your use of our website as well as an allocation to your company and possible interests. In addition, your IP address is transmitted. The information generated by your use of this website is transmitted to Demandbase servers, merged with other Demandbase data and stored for 13 months. 

Demandbase's servers are located in the USA and other countries outside of the European Union. The data may therefore also be processed by the provider in countries outside of the European Union. 17. Links Social Media

On our website you will find links to the social media services of Facebook, Twitter, Google+, YouTube, Pinterest and Instagram. Links to the social media services websites can be recognized by the respective company logo. If you follow these links, you will reach WIKA Mobile Control's corporate website at the respective social media service. Our website uses social plug-ins (“plug-ins”) of the social network facebook.com, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”).
